Welcome to Guiding Bear. Please read these Terms and Conditions carefully before using our website gudiel.us, our Guidel mobile application Guidel, or purchasing our Guidel Guiding Bear physical product.
By accessing, buying or using any of our Services, you agree to be bound by these Terms.
1. Description of Services
Guiding Bear offers a supportive ecosystem for the emotional and spiritual development of children and teenagers. Our services include:
The Site: An informational portal about our products and mission.
The Guidel App: An interactive application offering conversations, parent reports, affirmations, and other tools adapted to different age ranges (2-18 years).
The Product: A physical plush bear designed to interact with the Guidel App.
2. User Accounts and Subscriptions
Parent Accounts: To use the Guidel App, a parent or legal guardian must create an administrator account ("Parent Account") and set a security PIN. You are responsible for maintaining the confidentiality of your PIN.
Child Profiles: From the Parent Account, you can create profiles for one or more children. The App will adapt its content and security methods according to the profile's age group (Guiding Bear, Guiding Explorer, Guiding Mentor).
Subscriptions: Access to the App's full features requires an active subscription. We offer different plans with an initial free trial. Payments are processed through our third-party payment provider (e.g., Stripe). You are responsible for all subscription fees associated with your account.
3. Purchase of Physical Products
Pricing and Payments: All prices for the Guiding Bear Product are displayed on our Site. We reserve the right to change prices at any time. Payments are processed securely through third-party payment providers.
Taxes and Shipping: The final purchase price will include applicable sales taxes, which will be calculated automatically based on the shipping address. Shipping costs will be added during the checkout process.
International Orders: For shipments outside our country of operation, the customer is solely responsible for any customs duties, import taxes, or local fees that may apply.
Returns and Refunds: Our return and refund policy will be detailed on a separate page on our Site.
4. Use of the Application and Artificial Intelligence
Purpose of Service: The Guidel App and its artificial intelligence are designed as a supportive tool to foster emotional and spiritual growth. It is not a substitute for professional medical, psychological, psychiatric, or pastoral advice. Never disregard the advice of a qualified professional because of information obtained through our Services.
AI Limitations: While we strive to provide a safe and appropriate experience, you acknowledge that interactions with an AI may have limitations. We are not responsible for the interpretation of or actions resulting from conversations with the App.
Child Privacy: We respect the growing need for privacy as children mature. The App's features, such as parent reports and private modes, are adjusted according to the profile's age group, as described on our Site and App.
5. Intellectual Property
All content included in our Services, such as the bear's design, logos, text, graphics, images, audio, videos, and the App's software ("Content"), is the property of Guiding Bear or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our Content without our express written permission.
6. User-Generated Content
Users (parents) may create content within the App, such as recording affirmations in their voice ("User Content"). You retain ownership of your User Content. However, by creating it, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and display such Content for the sole purpose of providing the App's services to you.
7. Limitation of Liability
To the fullest extent permitted by law, Guiding Bear shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any content obtained from the Services; or (iii) the use of our physical Product.
8. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will notify you by posting the updated Terms on the Site. Your continued use of the Services after the effective date of the new Terms will constitute your acceptance of such changes.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
